1. Acceptance of Terms

By accessing or using QualMill ("the Service"), operated by H2i Digital, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

QualMill is a software-as-a-service platform that helps qualitative market researchers process interview transcripts and generate reports. The Service uses artificial intelligence as a drafting and synthesis aid to analyze content, extract insights, and assist with report writing.

3. Account Registration

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Free Trial and Subscriptions

We offer a 7-day free trial that provides access to a subset of paid features, as described on our site. After the trial period, you must subscribe to a paid plan to continue using the Service. Subscription fees are billed monthly in advance and are non-refundable except as required by law.

Each subscription tier has specific limits on workspaces, transcripts, and chat messages. If you exceed your plan limits, you will need to upgrade to continue using those features.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Upload content that infringes on intellectual property rights
• Upload content that is defamatory, obscene, or harmful
• Upload protected health information (PHI) or any data subject to HIPAA — QualMill is not HIPAA-certified and does not offer a Business Associate Agreement
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Use the Service to develop a competing product
• Resell or redistribute the Service without authorization
• Use automated methods to access the Service except where explicitly permitted by us
• Access the Service from any jurisdiction subject to U.S. export controls or economic sanctions

6. Your Content

You retain ownership of all content you upload to the Service, including transcripts, documents, and reports. By uploading content, you grant us a limited license to process, store, and display that content solely to provide the Service to you.

You represent that you have all necessary rights to upload and process the content you submit, including any required consent from research participants or data subjects.

We do not use your content to train our own AI models outside the operation of the Service. For details on how third-party AI providers handle your content, see our Privacy Policy.

7. AI-Generated Content

The Service uses artificial intelligence to analyze your content and generate reports. AI-generated outputs are provided as drafts and suggestions. You are responsible for reviewing, editing, and verifying all AI-generated content before using it in deliverables. We do not guarantee the accuracy, completeness, or suitability of AI-generated content.

8. No Professional Advice

The Service is a research productivity tool and does not provide legal, medical, financial, or other professional advice. Any outputs generated by the Service should not be relied upon as a substitute for consultation with qualified professionals.

9. Intellectual Property

The Service, including its design, features, and underlying technology, is owned by H2i Digital and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

10. Confidentiality

We understand that the content you upload may be confidential. We will not share your content with third parties except as necessary to provide the Service or as required by law, as described in our Privacy Policy. We maintain appropriate security measures to protect your data.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, H2I DIGITAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Termination

You may cancel your subscription at any time through your account settings or by contacting us. We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason at our discretion.

Upon termination, your right to use the Service will cease immediately. You may delete your account and all associated data at any time via account settings — deletion is initiated immediately and completed in accordance with our data retention practices as described in our Privacy Policy. If you cancel your subscription without deleting your account, we will retain your data for 30 days, after which it will be deleted.

14. Changes to Terms

We may modify these Terms of Service at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after such notification constitutes acceptance of the modified terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arkansas, United States, without regard to conflict of law principles.
